2.5 Limited Warranty. To the maximum extent permitted by law, Seagull Scientific and its licensees warrants the delivered Software against technical defects for one (1) year from the date of delivery. The Software may be returned, at Seagull Scientific's option, in a shipping container provided by Seagull Scientific or by other appropriate means to geographic locations within the limited warranty territory as determined by Seagull Scientific. Seagull Scientific may, at its option, repair or replace any warranted Product under warranty and charge the warranty expense to the applicable customer.

2.6 Warranty Extension. If the Software is delivered with a Software Product, Seagull Scientific reserves the right, at its option, to upgrade the warranty of the Software by one (1) year by offering a warranty extension to the applicable customer. If Warranty extension is provided, the applicable customer must return the Software within thirty (30) days of expiration of the original warranty. Warranty extension can be removed from the Software only if the relevant Customer receives a notice from Seagull Scientific which states that the extension has been removed ("Warranty Defeated Notice"). Warrantied software shall be repaired or replaced free of charge only with respect to defects arising within thirty (30) days of delivery of the Software. >The warranty period as referred to herein is 12 months from the date as shown on the Product Key or licensing information. Warranty period is not extended beyond the thirty (30) day extension deadline. Warranty period is not extended beyond the applicable customer's original purchase date or the date of delivery of the Software if that date is not visible or ascertainable on the Software itself.

2.7 Limitations on Use. Except as expressly permitted by Seagull Scientific, the applicable customer shall not distribute, sub-license, rent, lease or use the Software for time sharing, hosting or other use of the Software as a service or like purposes, directly or indirectly, except as may be authorized by Seagull Scientific. In case of an infringement of Seagull Scientific's copyrights or trademarks, or other Intellectual Property Rights, by the software, such infringement shall give rise to an appropriate civil claim. d2c66b5586
